Prosessin kehittämisen rooli julkisen hallinnon IT-hankkeessa : näkökulmana lainsäädäntöprosessi

Abstract

Tutkielmassa tarkastelen prosessin kehittämistä lainsäädäntöprosessin ja julkisen hallinnon tietotekniikan (IT:n) uudistamisen näkökulmista. Tutkielmassa yhdistyvät toimintaprosessien kehittämisen ja sähköisen julkisen hallinnon tieteellisen tutkimisen näkökulmat. Tarkastelen lainsäädäntöprosessin kehittämistä osana julkisen hallinnon arkkitehtuurikehyksen mukaista toiminta-arkkitehtuuria.

Tutkielma on kirjallisuuskatsaus lainsäädäntöprosessin ja sen tietojärjestelmätuen kehittämiseen liittyvään tietojärjestelmätieteen tutkimukseen. Esitän tutkielmassa tuloksia myös liiketaloustieteen ja oikeusinformatiikan ja -lingvistiikan tutkimuksista. Pyrin hyödyntämään aihepiiriin liittyvää laadullista ja määrällistä tieteellistä tutkimusta. Tutkielman lähtökohtana on aiempi hollantilaisen lainsäädäntöprosessin tutkimus, jossa hyödynnettiin toimintaprosessin kehittämismenetelmiä. Kartoitan tutkielmassa myös ajankohtaisia käytännön näkökulmia lainsäädäntöprosessin tietojärjestelmätuen kehittämiseen.

Tutkielman tavoitteena on vastata siihen, miten lainsäädäntöprosessin kehittäminen kytkeytyy julkisen hallinnon arkkitehtuurikehykseen ja tietoteknisten palvelujen kehittämiseen. Arkkitehtuurikehyksen periaatteellinen taso ohjaa lainsäädäntöprosessin kehittämistä osana toiminta-arkkitehtuurin näkökulmaa. Käsitteellisen ja loogisen tason kuvaaminen luo perustan lainsäädäntöprosessin ja sen tietoteknisten palveluiden ja liittymärajapintojen kehittämiselle. Lainsäädäntöprosessin menettelyjä määräävä lainsäädäntö on tärkeässä roolissa, kun parannetaan lainsääntöprosessin kehittämisen edellytyksiä ja mahdollisuuksia. Tutkielman lopputuloksena totean, että lainsäädäntöprosessia määräävien lainsäädännön vaatimusten hallinnalla voidaan lisätä kehittämisen joustavuutta ja ketteryyttä.

This paper examines the business process redesign from the legislative process and public administration information technology (IT) reform perspectives. This thesis combines examination of the business process research and the scientific aspects of public eAdministration development. The thesis focuses on the development of the legislative process as a part of the business architecture domain in accordance with the Finnish Public Administration Enterprise Architecture Framework.

The thesis is a literature review on the Information Systems Science research concerning the legislative process and its information technology services development. There are also research findings in Business Economics and Legal Informatics and Linguistics presented in this study. The thesis aims to take advantage of results on both the qualitative and quantitative scientific research. The thesis is based on the previous scientific research of the Dutch legislative process, where business process management methods were utilized. This thesis identifies also current practical aspects of the legislative process on the development of information technology enabled services.

The thesis aims to answer the question of how the legislative process development is linked to the Finnish Public Administration Enterprise Architecture Framework and information technology services development. The contextual level of architecture framework guides the development of the legislative process as a part of the viewpoint of the business architecture. Describing the conceptual and logical levels creates the basis for the development of the legislative process and its information technology services and interfaces. The legislation, which is regulating the legislative process, plays an important role in improving preconditions and opportunities for the legislative process re-engineering. The study result indicates that flexibility and agility in the development can be increased by the regulatory requirements management.
