dc.description.abstractLaura Leppämäki rakentaa väitöskirjatutkimuksessaan kokonaiskuvaa tekijänoikeuskeskustelusta, joka on muodostunut hyvin kriittiseksi vallitsevaa järjestelmää kohtaan. Tutkimus sivuaa myös nykytaiteen ongelmia ja tekijänoikeuden kriteereitä.Tekijänoikeus kohtaa voimistuvaa kritiikkiä erityisesti käyttäjien suunnalta. Myös uusien teosten tekijät kritisoivat tekijänoikeutta liian tiukkana ja luovuutta kahlehtivana, sillä varsinkin jo olemassa olevien töiden hyödyntäminen on hankalaa. Olisi myös hyvä miettiä, onko omistaminen ja siitä kiinnipitäminen aina kohtuullista ja tarpeellista. Voiko liian tiukka tekijänoikeus myös rajoittaa luovuuden ilmenemistä yhteiskunnassa?Tekijänoikeuden teosluetteloa olisi hyvä tarkastella uudestaan. Samat kriteerit eivät sovi ongelmitta kaikkiin teoksiin. Tekijänoikeutta tulisi kehittää siten, että tekijänoikeudesta vapaat teokset olisi helpompi selvittää ja löytää. Nyt edellytetään omatoimisuutta ja tekijänoikeuslain tuntemista, jota kaikilla teoksia hyödyntävillä ei ole. Toisaalta tekijänoikeutta voisi kehittää vaatimalla jonkinlaista tasoa tai laatua.Ajatus automaattisesti syntyvästä tekijänoikeudesta asettaa lisäkysymyksiä siitä, kuka saa määritellä tekijänoikeuden piiriin kuuluvat teoskynnyksen ylittävät teokset. Tekijänoikeutta tulisi saattaa läpinäkyvämmäksi ja selkeämmäksi, jotta laki avautuisi myös oikeudellisiin kysymyksiin perehtymättömälle, huomauttaa Leppämäki.Leppämäki perehtyi tekijänoikeuden oikeuttamiseen oikeusfilosofian näkökulmasta. Lähtökohtana on angloamerikkalainen teoreettinen tekijänoikeuskeskustelu, jota käydään erityisesti oikeustieteellisissä aikakausijulkaisuissa. Tällä hetkellä keskustelussa korostuvat seuraavat neljä oikeuttamisen näkökulmaa: 1) tekijänoikeus voidaan oikeuttaa tehtyyn työhön vedoten 2) tekijänoikeuden voidaan ajatella hyödyntävän koko yhteiskunnan kehitystä 3) vetoaminen teoksen ja tekijän väliseen sidokseen, joka on hyvin henkilökohtainen ja läheinen 4) demokratiavaatimusten korostaminen. dc.description.abstractThis work consists of six academic articles. The common theme throughout all of them is the justification of copyright in an Anglo-American theoretical debate. I also try to present the most common problems related to justification. Copyright is presently under a great deal of a pressure, and scholarly interest in this field is increasing rapidly. One reason for the dilemma of copyright is the inadequacy of justification.Copyright belongs to the legal category of intellectual property rights. Copyright is a form of protection provided to authors of “original works of authorship“ by the law of copyright. This concept includes literary, dramatic, musical, artistic, and certain other intellectual works. Copyright can be divided into two parts: moral and economic rights. The terms are used mainly in theoretical literature. Particularly the latter concept is emphasised in western countries for several reasons. Economic rights have emerged partly as a result of the strengthened position of cultural industry. On the other hand liberalism is the leading theory in political and economical philosophy in western countries. Economic rights play the most central role in liberalism. John Locke is called ”the father of liberalism.” His influence on the law of copyright can be seen in the background arguments of economic rights. Locke proposes that a person possesses a natural right to the fruits of his or her labour. This famous argument has encountered resistance for a number of reasons. For example, the analogy between material and intellectual property does not work. The other popular argument, utilitarianism, stresses the importance of the maximisation of net social welfare. My articles discuss the subject of justification through four separate approaches. The labor theory and utilitarianism dominate the theoretical literature, but other approaches are gaining popularity in the field. Copyright can be seen as crucial to the satisfaction of certain fundamental human needs and to the maintenance of a vital democratic civil society. I attempt to clarify the basic arguments of each of the four approaches, labor theory, utilitarianism, personality theory and social planning theory. I also concentrate on the problems related to the criteria of copyright. This work is intended to address the general problems of justification, but it also touches on the problems related to copyright and modern art.en
